Focus on Financial Aspects of Business Operations in China


Ms. Xiaohua (Sarah) Zhao, a partner in Akin Gump’s Washington, D.C. office, brought her expertise on various Chinese law issues, including correctly designing the appropriate corporate structure to allow operational and financial flexibility.

Mr. Robert Arthur, Principle in Charge of International Tax Services, Parente Randolph LLC, addressed another issue that is critical for any company’s profitable operations in China, i.e. gaining a correct understanding of the tax implications. Starting with the “Why pay taxes twice?” question, he discussed numerous tax considerations to be wary of or to take advantage of, depending on the issue.

Presenting case studies of companies that had faced financial difficulty when investing into or trying to repatriate money out of China, Ms. Zhao and Mr. Arthur both demonstrated how appropriate corporate structure and correct understanding of the tax implications could have saved those companies time and money. December COC speakers also touched upon such financial topics as: appropriate procedures for capital flows, Chinese audit requirements, Value Added Tax matters and considerations for financial terminology in the financial documentation.
